Terms of Use
Welcome to Weather Compass ("the App"). The App is operated by Stephen Devoe o/a ProBuilder Software ("we", "us", "our"). By accessing or using the App, you agree to be bound by these Terms of Use. If you do not agree with these terms, do not use the App.
1. Description of Service
Weather Compass is a free, map-based progressive web application that provides weather forecasts, marine forecasts, radar imagery, wildfire tracking, air quality data, weather alerts, and a digital compass for locations in Canada and the United States. The App aggregates data from third-party sources and presents it for general informational purposes.
2. Not for Safety-Critical Decisions
THE APP IS PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY. Weather Compass is not a substitute for official weather warnings, marine forecasts, or emergency communications from government agencies. Do not rely on this App for safety-critical decisions including but not limited to:
- Aviation, maritime navigation, or offshore operations
- Evacuation decisions during severe weather, wildfires, or natural disasters
- Agricultural, construction, or industrial operations where weather conditions are safety-critical
- Any situation where inaccurate weather information could result in injury, death, or property damage
Always consult official sources such as Environment Canada, the National Weather Service, and the Canadian Coast Guard for safety-critical information.
3. Compass Disclaimer
The digital compass feature reads your device's built-in magnetometer. Accuracy depends on your device hardware, calibration, and proximity to magnetic interference (metal objects, electronics, vehicles, buildings). The compass is for reference only and is not suitable for navigation. We are not responsible for any consequences arising from reliance on compass readings.
4. Coast Guard SOS Feature
The Coast Guard SOS feature is a convenience tool that helps you quickly call the nearest coast guard station. It is not a replacement for VHF Channel 16, 911, or other official emergency communication channels. In an emergency, always use the most reliable means of communication available to you. We do not guarantee the availability, accuracy, or timeliness of coast guard station contact information. We are not responsible for any failure to connect with emergency services.
5. Wildfire Data
Active fire data is sourced from NASA's Fire Information for Resource Management System (FIRMS) and reflects satellite-detected hotspots. This data may be delayed, may not reflect current conditions, and may include false detections. Do not use this data for evacuation planning, firefighting operations, or any safety-critical purpose. Always follow official guidance from local fire and emergency management authorities.
6. Third-Party Data and Services
The App relies on data from third-party providers including Open-Meteo, RainViewer, NASA FIRMS, Environment Canada, and the National Weather Service. We do not control the accuracy, completeness, timeliness, or availability of third-party data. We are not responsible for errors, outages, or inaccuracies in data provided by third parties.
7. Accuracy of Information
While we strive to present accurate and timely information, weather data is inherently uncertain. Forecasts are predictions, not guarantees. Actual conditions may differ significantly from what the App displays. We make no warranty or representation regarding the accuracy, reliability, or completeness of any information provided through the App.
8. Availability
We do not guarantee uninterrupted or error-free operation of the App. The App may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the App at any time without notice.
9. Intellectual Property
All content, design, code, graphics, and branding in Weather Compass are the property of Stephen Devoe o/a ProBuilder Software, unless otherwise noted. You may not copy, modify, distribute, or reverse-engineer any part of the App without our written permission. Third-party data and map tiles remain the property of their respective providers.
10. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to interfere with, disrupt, or overload the App or its infrastructure
- Scrape, crawl, or harvest data from the App by automated means
- Attempt to gain unauthorized access to any part of the App or its backend systems
- Misrepresent your identity or affiliation when contacting us
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STEPHEN DEVOE O/A PROBUILDER SOFTWARE, ITS AFFILIATES, AND ITS DATA PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
This includes but is not limited to damages arising from: inaccurate weather or marine forecasts, compass readings, wildfire data, or alert information; reliance on any information provided through the App; service interruptions or data loss; or any other matter relating to the App.
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
12. Indemnification
You agree to indemnify, defend, and hold harmless Stephen Devoe o/a ProBuilder Software from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of any third party.
13. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will meet your requirements, operate without interruption, be error-free, or that any data provided will be accurate or reliable.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede any prior agreements or understandings.
17. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
